What Happens If a Tree Falls On My Property During a Storm?

A Tree Fall in My Property

As we enter the thick of winter here in Australia, one thing is for certain: wet and windy weather. We’ve already experienced our fair share of stormy weather here in Queensland, and there are still a few winter months ahead. Stormy weather can bring about all kinds of unwanted outcomes, from damage caused by floods to wind-ravaged trees tumbling onto private properties.

Trees and bad weather can pose a significant hazard, and it may leave you asking, 'what should I do if a tree falls on my property during the stormy season?

Who is responsible for the damage?

In the case of a tree falling during a storm, there isn’t really anyone who is ‘responsible’. Insurance policies will typically cover these events under ‘Acts of Nature’. Whether you’re currently living in the property or it’s an investment home, you should always have building and contents insurance.

In most instances of a tree falling and damaging property, your insurance provider will arrange for an approved contractor to assess the damage and remove the tree and any debris.  Insurance policies will only cover your property, so if the tree has damaged multiple properties, each person needs to contact their own insurance provider to lodge a claim.

Check the small print

It is essential to read the small print on your insurance policies and ensure they cover the damage caused by falling trees. Some insurance will only assist if the tree has caused damage, whether to your property or other contents (for example, a push-bike, outside buildings such as a shed or garage).

Some buildings and contents policies won’t cover cars and motorised bikes, so you’ll need to check your independent insurance for those items if they have been damaged at all. If a tree has fallen but not damaged any property, you may be responsible for arranging for the tree and any debris to be removed yourself.

Should you remove the tree yourself?

DIY tree removal might be possible, and it can be tempting to deal with it yourself, but we don't recommend it for several reasons. It can be especially hazardous if the tree has fallen onto and damaged a part of a building. Whether a shed, garage, or part of a house, the tree may have caused structural damage, making it dangerous to remove the tree in whole or part on your own.

While waiting for your claim to be processed, you can:

• Take photos and make a written account of the damage.
• Cover any holes or smashed windows with cardboard.
• Remove loose bits of debris that might be scattered around and cause a further hazard.

What happens once you lodge a claim?

Once you have lodged a claim with your insurance provider, they’ll assign a tree services professional to handle the situation safely. You don’t always get a say in who attends to your property when lodging a claim, but rest assured, they’ll use a reputable and reliable organisation, just like us.
